    California Builders Right To Repair Current Law Summary:

    Current Law Summary: SB800 (codified as Civil Code §§895, et seq) is the most far-reaching, complex law regulating construction defect litigation, right to repair, warranty obligations and maintenance requirements transference in the country. In essence, to afford protection against frivolous lawsuits, builders shall do all the following:A homeowner is obligated to follow all reasonable maintenance obligations and schedules communicated in writing to the homeowner by the builder and product manufacturers, as well as commonly accepted maintenance practices. A failure by a homeowner to follow these obligations, schedules, and practices may subject the homeowner to the affirmative defenses.A builder, under the principles of comparative fault pertaining to affirmative defenses, may be excused, in whole or in part, from any obligation, damage, loss, or liability if the builder can demonstrate any of the following affirmative defenses in response to a claimed violation:

    Forget Fifth Graders - Are You Smarter Than a CEO?

    December 02, 2025 —
    The Supreme Court of South Dakota says that (in certain circumstances) you need to be. That court wrangled with the evidentiary requirements for professional negligence and breach of contract claims arising from the construction of a clinical research facility in Brookings, South Dakota. The general contractor on the project alleged defects in the design and installation of the HVAC system and suspended ceiling, resulting in contamination and operational failures. The general contractor sued the architect, engineers, and contractors, asserting breach of contract and implied warranties. Read the full story...

    Assignment of Claim not Precluded by Policy’s Anti-Assignment Clause

    October 21, 2025 —
    The Supreme Court of Maryland upheld the insured's assignment of a post-loss claim despite the policy's anti-assignment provision. In re Featherfall Restoration, LLC, 2025 Md. LEXIS 294 (Md. July 24, 2025). The insureds purchased a "High Value' homeowners policy from Travelers Home and Marine Insurance Company for their residence. The policy included an anti-assignment clause: "Assignment of this policy will to be valid unless we give our written consent." Three months after the policy expired, the insureds notified Travelers of damage to their roof that they contended resulted from a wind and hailstorm that occurred before the policy expired. The insureds hired Featherfall Restoration, LLC to repair their roof. Read the full story...

    Why Hurricane Preparedness Isn’t About the Property

    November 21, 2025 —
    Along Florida’s 8,436 miles of shoreline, residents face a persistent threat: hurricanes and the often catastrophic damage these natural weather events inflict. Come late summer and autumn, meteorologist forecasts transition from sun and clear skies to overcast days, high winds and heavy rainfall that signal disaster may be afoot. The state’s construction industry is particularly sensitive to volatile weather patterns, with real estate developments at high risk of destruction if hurricanes cross their path. And with each significant weather event, the losses are substantial. According to the National Centers for Environmental Information, there were nearly 100 disaster events in Florida with financial losses exceeding $1 billion each between 1980 and 2024.     Colorado Appeals Court Clarifies “Control” Exception to Statute of Repose

    July 15, 2025 —
    In a recent Colorado Court of Appeals decision, Kritzer v. Qwest Corporation, the Colorado Court of Appeals reaffirmed the protections offered by the statute of repose under Colorado’s Construction Defect Action Reform Act (“CDARA”)---but also reminded practitioners that those protections are not absolute. For construction professionals, subcontractors, and public utilities, the case illustrates how ongoing maintenance obligations, even years after project completion, may keep the door open to liability long after you thought it was shut. The Background: A Sidewalk, a Bicycle Crash, and a Six-Year Gap In 2010, Qwest Corporation and its subcontractors installed underground fiber optic cables near Cherry Hills Village Elementary School. To access the cables, they removed and replaced a section of sidewalk. That work wrapped up in February 2010. Read the full story...
