    California Builders Right To Repair Current Law Summary:

    Current Law Summary: SB800 (codified as Civil Code §§895, et seq) is the most far-reaching, complex law regulating construction defect litigation, right to repair, warranty obligations and maintenance requirements transference in the country. In essence, to afford protection against frivolous lawsuits, builders shall do all the following:A homeowner is obligated to follow all reasonable maintenance obligations and schedules communicated in writing to the homeowner by the builder and product manufacturers, as well as commonly accepted maintenance practices. A failure by a homeowner to follow these obligations, schedules, and practices may subject the homeowner to the affirmative defenses.A builder, under the principles of comparative fault pertaining to affirmative defenses, may be excused, in whole or in part, from any obligation, damage, loss, or liability if the builder can demonstrate any of the following affirmative defenses in response to a claimed violation:

    Elliott Backed Venture Sues Lloyds Over Avant Cladding, Times Reports

    February 17, 2026 —
    Elliott Investment Management and British housing tycoon Jeff Fairburn, joint-venture partners in UK homebuilder Avant Homes Group, are suing Lloyds Banking Group Plc over who should pay to fix properties that fail to meet post-Grenfell fire-safety standards, the Times reported. Avant, which faces remediation costs of at least £107 million ($146 million) for potentially dangerous cladding, argues that Lloyds should shoulder part of the bill because most of the developments were built before 2014, when the homebuilder was under the bank’s ownership, the Times reported. Cladding has become a contentious issue in the UK following the Grenfell Tower fire in June 2017, in which dozens died after flames spread rapidly through flammable exterior cladding on the West London high-rise, laying bare deep failures in Britain’s building safety regulations.     Trust, But Verify: Addressing Risk of Non-Payment by Owners

    December 08, 2025 —
    Receiving payment is an important piece of any for-profit business. And construction contractors are no exception. But sometimes payments do not arrive on time (or, worse yet, not at all), even when a contractor has done everything right. Ensuring that owners have the ability to pay invoices when they become due is an important upfront risk mitigation strategy that can help reduce future risks of non-payment. Although it is not possible to entirely remove this risk, there are options to help reduce it. This article will highlight some of the options to help increase payment security, both before and during the Project, to reduce the risk of non-payment for work that is otherwise properly performed. This article does not cover the entire waterfront of available options, including liens (which could be a separate topic for an entire thesis). But this article nonetheless provides some practical options for consideration to reduce payment risks. Read the full story...

    Construction Expert and Judge Living in the Same Hood Is Not Grounds For Recusal

    December 08, 2025 —
    In a recent Tennessee Court of Appeals decision, Nowaczyk v. Daniels Construction (Nov. 4, 2025), a contractor tried to disqualify the trial judge because the judge happened to live in the same neighborhood as a potential expert witness for the homeowners. The court’s response? Proximity isn’t prejudice. The dispute started when homeowners sued Daniels Construction for allegedly botched remodeling work. When the judge disclosed during a hearing that he lived near the plaintiffs’ proposed expert, the defense moved to have him recused from the case. They argued that prior cases involving the same expert had led to recusals. The trial judge, however, made clear there was no personal or professional relationship with the expert and denied the motion. Read the full story...

    Insured’s Breach of Contract Claim Survives Motion to Dismiss, but Bad Faith Claim Does Not

    November 21, 2025 —
    The court denied the insurer’s motion to dismiss the insured’s breach of contract claim, but granted the motion to dismiss without prejudice the bad faith claim. Terrazas v. State Farm Fire & Cas. Co., 2025 U.S. Dist. LEXIS 173920 (D. Colo. Sept 5, 2025). The plaintiff, Alejandro Garcia-Terrazas, had a policy issued by State Farm. The policy covered the abrupt and accidental discharge or overflow of water. Terrazas noticed a water discharge or overflow in the kitchen. The water caused damage to the floors, cabinets, and other items in the kitchen. A claim was filed with State Farm. State Farm investigated but refused to pay the full value of the claim.     Applying Jury Verdict Method in Quantifying Damages Due to Defective Specifications

    March 31, 2026 —
    An older case deals with three important considerations: (1) defective specifications; (2) whether the defective specifications were misleading or misrepresentative; and (3) applying the jury verdict method in quantifying damages. In Metric Construction Co., Inc. v. U.S., 80 Fed. Cl. 178 (Fed. Cl. 2008), a contractor was contracted by the federal government to construct a warehouse. There were defects in the structural steel design specifications underlying the standing seam metal roof installed by the contractor and, as a result, the roof system leaked causing damage. The contractor incurred significant costs in repairing the damage, and pursued recovery of these costs against the government. The contractor claimed the structural steel design serving as the framework for the metal roof was defective and misleading and caused the leaks. Read the full story...
