    California Builders Right To Repair Current Law Summary:

    Current Law Summary: SB800 (codified as Civil Code §§895, et seq) is the most far-reaching, complex law regulating construction defect litigation, right to repair, warranty obligations and maintenance requirements transference in the country. In essence, to afford protection against frivolous lawsuits, builders shall do all the following:A homeowner is obligated to follow all reasonable maintenance obligations and schedules communicated in writing to the homeowner by the builder and product manufacturers, as well as commonly accepted maintenance practices. A failure by a homeowner to follow these obligations, schedules, and practices may subject the homeowner to the affirmative defenses.A builder, under the principles of comparative fault pertaining to affirmative defenses, may be excused, in whole or in part, from any obligation, damage, loss, or liability if the builder can demonstrate any of the following affirmative defenses in response to a claimed violation:

    Allegations in Insured’s Complaint Sufficient to Survive Motion to Dismiss

    November 09, 2025 —
    The insured’s complaint sufficiently pled breach of contract and bad faith to survive the insurer’s motion to dismiss. Macias v. Am. Family Ins. Co., 2025 U.S. Dist. LEXIS 148628 (D. Colo. Aug. 1, 2025). A hailstorm damaged the insureds’ property, including the roof. The insureds filed a claim (Claim One) with American Family. An adjuster assigned by American Family found storm-related damage to the gutters, window screens and lattice work, but only non-storm-related damage to other items, such as the roof. American Family determined the losses amounted to $1,104.97, which was below the deductible. Read the full story...

    New Tools, Streamlined Access: AAA’s Website Gets a Major Redesign

    If you’ve handled construction disputes, chances are you’ve interacted with the American Arbitration Association (AAA). As one of the leading forums for alternative dispute resolution in the industry, the AAA is central to how many construction contracts manage conflict. According to a recently AAA announcement, it just got a lot easier to use. Earlier this week, the AAA officially launched its redesigned website at www.adr.org, and the updates are worth noting, particularly for parties who customarily deal with arbitration or mediation. What’s New on the AAA Website? The new site is faster, more intuitive, and designed to give users quick access to rules, forms, case data, and educational resources. Here are a few key improvements that stand out: 1. AI Tools and Technology Hub AAA has consolidated its artificial intelligence offerings into a centralized hub.     $57M Settlement Keeps Red River Diversion Project Claims Out of Court

    July 28, 2025 —
    The contractor and the flood control authority for the massive Red River diversion project in North Dakota have resolved $400 million in claims with a $57-million settlement. Much of what was negotiated concerned delay claims related to permits, third-party railroads and compliance with regulatory requirements, said a spokeswoman for the Metro Flood Diversion Authority (MFDA). A small part related to the failure to use epoxy coating on rebar in parts of the project to protect against corrosion, she said. Read the full story...

    Shiloh and Vallejo: The DOI Tale of Two Properties

In particular, challenges abound as to the Department of the Interior (the DOI) and its decisions to take certain parcels of land into trust for the purpose of rendering such parcels eligible for gaming activities by certain California tribes. The DOI Shiloh Parcel Dispute The Shiloh parcel, a tract of land the DOI previously approved as land taken into trust for gaming purposes under the restored lands exception of the Indian Gaming Regulatory Act (IGRA) on behalf of the Koi Nation of Northern California (The Koi), has been the subject of considerable controversy.     How Slow and Steady Can Lose the Race - Pacing and Delay Claims

    September 23, 2025 —
    In the well-known fable, the tortoise’s slow and steady pace prevailed. But how often do your construction projects resemble a fairy tale? The practice of “pacing” makes common sense in construction just as it does in racing. But pacing can be misunderstood in the context of a delay claim and can even cause the contractor to lose its claim for delay damages. Here’s a cautionary look at pacing and delay claims. The concept of liability for delay is familiar, but important to restate as a foundation of this discussion. Delays fall into one of four categories, with differing outcomes.
    • Owner-caused delays are often called “compensable delays.” The contract and/or common law typically allows the contractor relief for added time and cost for these delays. (This is contemplated in Section 6.3.2 of ConsensusDocs 200.)
