White House Explores Opening Antitrust Probe on Homebuilders

Trump administration officials are exploring opening an antitrust investigation into US homebuilders as the White House sharpens its focus on tackling the country’s housing affordability crisis. The Department of Justice could open the probe in the coming weeks, according to people familiar with the discussions. No decision has been made and the administration may abandon the effort without launching an investigation, the people said, asking not to be identified discussing non-public information. Contracting Chaos? How Mid-America v. US Department of Transportation is Upending DBE Certifications

Since the early 1980s, Disadvantaged Business Enterprise (DBE) programs including the one implemented by the US Department of Transportation (DOT) have been in effect. The DBE program began under Title VI of the Civil Rights Act and has been reauthorized by Congress in various bills over the years. Generally, these DBE programs have required that ten percent of federal highway construction funds be paid to small businesses controlled and owned by “socially and economically disadvantaged individuals.” Certain minority and women owned businesses have been given a presumption of disadvantage to facilitate their participation in federally‑assisted DOT contracting. While any person may qualify as socially and economically disadvantaged regardless of their race or gender, certain racial groups and women are rebuttably presumed to be disadvantaged. All other applicants seeking DBE status who are not presumed disadvantaged on the basis of their racial or female status must prove, by a preponderance of the evidence, that they are socially and economically disadvantaged. Many states have enacted similar requirements governing state and local projects. Recently, the presumption of disadvantaged status has come under attack in Mid‑America Milling Company v. U.S. Department of Transportation[i] pending in the U.S. District Court for the Eastern District of Kentucky. Sacramento Team Obtains Defense Verdict for Motel Client in Unruh Act Lawsuit over Trip-and-Fall Incident

Sacramento, Calif. (September 24, 2025) - Sacramento Partner Shane Singh and Associate Grace Mehta of Lewis Brisbois’ Labor & Employment and ADA Compliance & Defense Practices recently secured a defense verdict for a motel client following a three-week trial in an Unruh Act lawsuit arising from a trip-and-fall incident in 2019. The incident in question occurred in August 2019 at the client's motel in Barstow, California. The plaintiff, an elderly woman, had alleged she booked an accessible room at the motel through an online service. Upon arrival at the motel, the motel did not have a record of the accessible room request and the only ADA accessible room at this motel was already occupied. Additionally, the accessible room had one bed and plaintiff's party desired two beds. The motel allowed the party to examine a room on the first floor with two beds. The plaintiff and her party examined the room and then accepted it for their one-night stay. Read the full story...

EPA Proposes New WOTUS Definition, Narrowing Clean Water Act Jurisdiction

On November 17, 2025, the United States Environmental Protection Agency (EPA) published a proposed rule that would significantly narrow its regulatory authority over Waters of the United States (WOTUS). Under the new proposed WOTUS rule, EPA would effectively have jurisdiction only over relatively permanent waters and a smaller subset of directly connected wetlands. The WOTUS definition outlines the geographic reach of the U.S. Army Corps of Engineers’ and EPA’s authority under the 1972 Clean Water Act to regulate streams, wetlands, and other water bodies. As such, it has been reviewed in boardrooms, courtrooms, and government offices for over fifty years. Most recently, on May 25, 2023, the U.S. Supreme Court issued its opinion in Sackett v. EPA. In Sackett, the Supreme Court determined that WOTUS are only (1) relatively permanent bodies of water, such as oceans, lakes, rivers, and streams; or (2) adjacent wetlands indistinguishable from those waters because of a continuous surface connection.
